9. About these terms

  1. These terms apply to every person who participates in the Programme, including Referrers, Referred Customers and any other person accessing a referral page, referral dashboard or related service.
  2. The Programme is a promotional referral arrangement. It is not an employment, agency, partnership, introducer appointed representative or regulated intermediary appointment, unless Spot On has signed a separate written agreement expressly stating otherwise.
  3. Participation is voluntary and is subject to applicable law, regulation, eligibility checks, fraud screening and these terms.
  4. Spot On may update these terms from time to time. The version that applies to a participant is the version available when the relevant referral activity takes place (i.e. when the Qualifying Policy is purchased), unless the law requires otherwise.
  5. Where Spot On publishes campaign-specific rules, landing page terms, partner terms or reward details, those rules apply alongside these terms. If there is a conflict, the campaign-specific rules will apply only to the extent of the conflict.

10. Access to referral services

  1. Spot On may provide referral links, landing pages, tracking tools, dashboards, emails, fulfilment tools and other technology used to operate the Programme.
  2. Participants must provide accurate, complete and non-misleading information when using the Programme.
  3. Participants are responsible for maintaining their own devices, software, internet access and security settings needed to use the Programme.
  4. Spot On does not charge participants a fee to access the Programme.
  5. Spot On may suspend, restrict or withdraw access to all or part of the Programme where it reasonably considers this necessary to protect customers, prevent misuse, comply with law or regulation, maintain security, or protect the proper operation of the Programme.

11. Participant conduct

  1. Participants must not use the Programme:
    • for unlawful, misleading, abusive, harmful or fraudulent purposes;
    • to misrepresent their identity, relationship with Spot On, entitlement to refer, or eligibility for a Reward;
    • to interfere with, damage, overload, disrupt, reverse engineer or compromise Spot On systems, referral pages or tracking technology;
    • to access or attempt to access another person's account, referral link or dashboard;
    • to generate referrals through automated methods, bots, scripts, paid traffic, misleading advertising, public voucher sites, mass marketing, spam, scraping or similar activity;
    • to promote the Programme on websites, forums, blogs, social media accounts or online communities that exist primarily to generate referral income, discounts, cashback or other incentives, unless Spot On has approved this in writing;
    • in a way that could harm Spot On, its customers, its insurers, its partners, or the reputation of the Programme.
  2. Spot On may reject a referral, close a referral account, remove access to a dashboard, withhold Rewards, claw back Rewards or take other reasonable steps where it suspects breach, manipulation, gaming, duplicate activity, fraud, regulatory risk or misuse of the Programme.

12. Referral communications

  1. A Referrer must only send a referral to someone they personally know or to someone they have a legitimate reason to contact.
  2. Where reasonably practicable, the Referrer should obtain the recipient's permission before sending a referral communication.
  3. The Referrer is the sender of any personal referral message they choose to send. The Referrer must comply with applicable rules on marketing, privacy and electronic communications.
  4. Referral links must not be used for bulk distribution, unsolicited commercial communications, paid advertisements, lead generation, public discount listing, or any message that could reasonably be treated as spam.
  5. The Referrer must not claim to be authorised to give insurance advice, make regulated recommendations, bind cover, negotiate insurance contracts, alter policy terms, deal with claims, or act on behalf of Spot On unless they have separate written authority to do so.
  6. The Referrer must not make statements about Spot On products, pricing, eligibility, cover, exclusions or claims handling that are inaccurate, incomplete, misleading, unfair or inconsistent with Spot On's official customer communications.

13. Qualifying Policy requirements

  1. A Referred Customer must purchase a Qualifying Policy via the approved referral journey.
  2. A policy will not be a Qualifying Policy if the customer was previously a Spot On customer, was already in an active sales journey before using the referral link, used an excluded channel, failed eligibility checks, cancelled before satisfying the payment conditions, or otherwise failed to meet these terms.
  3. Spot On's referral tracking records will be used to determine whether a purchase was made through the referral journey, subject to any correction Spot On reasonably considers necessary to address obvious technical error, fraud or misuse.
  4. A referral link does not guarantee that Spot On will offer insurance, accept a customer, provide a particular premium, or issue a policy. Insurance remains subject to underwriting, eligibility criteria, policy terms and applicable law.

14. Rewards

  1. The standard Reward is a £20 cash reward for each eligible Referrer and each eligible Referred Customer, unless Spot On publishes a different reward for a particular campaign.
  2. Rewards are earned only when all conditions in these terms have been met and verified by Spot On or its fulfilment provider.
  3. Spot On may use third-party fulfilment providers to issue Rewards. Participants may need to follow reasonable instructions in the Reward fulfilment email to claim or receive the Reward.
  4. Rewards are promotional benefits. They are not interest, premium refunds, wages, commission, regulated remuneration or consideration for insurance advice.
  5. No alternative reward, substitute or additional compensation is available unless Spot On chooses to offer one.
  6. Participants are responsible for any tax consequences arising from receipt of a Reward.
  7. Spot On is not responsible for a Reward being delayed, lost, declined or undeliverable because a participant provided inaccurate contact details, failed to follow fulfilment instructions, breached these terms, or failed to keep their email account available.

15. Fraud prevention and misuse

  1. Spot On may take reasonable steps to detect and prevent fraud, misuse, self-referrals, duplicate accounts, false identities, artificial transactions, channel manipulation, incentive abuse and attempts to circumvent these terms.
  2. Those steps may include checking referral activity, policy data, payment status, contact details, device or technical information, publicly available information and information provided by fulfilment or technology suppliers, in accordance with the privacy policy and applicable law.
  3. Spot On may reject or cancel Rewards where it reasonably believes that referral activity is not genuine, has been generated for commercial exploitation, or is inconsistent with the purpose of the Programme.
  4. The Programme is intended for genuine personal referrals and approved distribution activity only. It must not be used as an unauthorised commercial referral business or lead-generation scheme.

16. Data protection

  1. Spot On will process personal data collected in connection with the Programme for purposes including operating the Programme, tracking referrals, verifying eligibility, issuing Rewards, preventing fraud, handling support queries, complying with law and improving the Programme.
  2. Personal data may include names, contact details, referral identifiers, policy status, payment status, technical information and information needed to verify Reward eligibility.
  3. Personal data will be processed in accordance with our Privacy Policy. Participants should read that privacy policy before taking part.
  4. Spot On does not knowingly invite children to participate in the Programme. A person under 18 must not use the Programme or provide personal data through it.
  5. Support queries may be handled by secure tools, automated systems, AI-enabled tools and trained support agents. Participants should not include sensitive information such as government identity documents, medical information, full payment card details or unnecessary personal information in referral support messages.
  6. Where third-party suppliers help operate referral tracking, dashboards, communications or Reward fulfilment, Spot On will use them in accordance with applicable data protection requirements.

17. Websites, links and technology

  1. Referral pages, dashboards and supporting systems may be hosted or operated by Spot On or its suppliers.
  2. Spot On does not guarantee that the Programme will always be available, uninterrupted, error-free, secure, free of viruses or compatible with every device or browser.
  3. Participants must not knowingly introduce viruses, malware, harmful code or other technologically harmful material into Spot On systems.
  4. The Programme may include links to third-party websites. Spot On is not responsible for the content, availability, privacy practices or security of third-party websites that it does not control.
  5. Participants should make their own assessment before using third-party websites or purchasing products or services through them.

18. Intellectual property

  1. All intellectual property rights in the Programme, referral pages, dashboards, content, branding, technology, materials and related systems belong to Spot On, its group companies, licensors or suppliers.
  2. Participants receive only a limited, revocable, non-transferable permission to use the referral materials for the purpose of participating in the Programme in accordance with these terms.
  3. Participants must not copy, adapt, distribute, sell, sublicense, misrepresent or misuse Spot On materials, branding or referral technology except as expressly permitted by these terms or by Spot On in writing.
  4. Any feedback, suggestions, ideas or comments provided to Spot On about the Programme may be used by Spot On without restriction and without compensation, provided Spot On does not use personal data except in accordance with its privacy policy.

19. Changes, suspension and withdrawal

  1. Spot On may vary, suspend, limit or withdraw the Programme, any campaign, any Reward, or any participant's access to the Programme at any time where it reasonably considers this necessary or appropriate.
  2. Where a Reward has already been validly earned before the effective date of a change or withdrawal, Spot On will honour that Reward unless these terms allow it to be withheld, cancelled or clawed back.
  3. Spot On may correct obvious errors in programme materials, landing pages, reward amounts, eligibility criteria or communications.

20. Liability

  1. Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
  2. Subject to section 20.1, Spot On will not be liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity, loss of anticipated savings, reputational damage, or loss arising from a participant's failure to comply with these terms.
  3. Spot On is not responsible for losses caused by events outside its reasonable control, third-party platforms, participant error, unavailable systems, inaccurate contact details, or technical issues that prevent referral tracking, except where the law provides otherwise.
  4. Nothing in these terms affects any statutory rights a consumer may have.

21. General

  1. Participants may not transfer their rights or obligations under these terms to anyone else.
  2. Spot On may transfer, assign, subcontract or delegate its rights and obligations under these terms, provided this does not materially reduce consumer protections required by law.
  3. A person who is not a party to these terms has no right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
  4. If any part of these terms is found to be invalid, unlawful or unenforceable, that part will be treated as removed to the minimum extent necessary and the remaining terms will continue to apply.
  5. Any failure or delay by Spot On in enforcing these terms does not prevent Spot On from enforcing them later.
  6. These terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any dispute arising from or relating to these terms, except where applicable consumer law provides otherwise.
